These Terms of Service ("Terms") govern your use of this website and your reservation of and participation in The Founders' Retreat, offered by Empowered Fitness & Recovery LLC ("EFR," "we," "us," or "our"). By using this site or reserving a seat, you agree to these Terms.
The offering
The Founders' Retreat is a private, hosted wellness retreat for a limited group of guests. Specific dates, inclusions, and details are described on this website and in your reservation communications. The destination is disclosed to confirmed guests. We may make reasonable substitutions to programming, practitioners, venue, or activities without materially reducing the overall experience.
Reservations, deposits, and payment
A reservation is made by submitting the required information and a deposit of $5,000 through our payment processor. Your deposit reserves your seat. The balance of the total price ($25,000 per seat) is due approximately 60 days before the retreat, unless otherwise agreed in writing. Seats are limited and are confirmed on a first-come basis.
Cancellation and transfers
Your $5,000 deposit is non-refundable once your seat is confirmed, because confirming your seat is what allows us to commit to the property and vendors on your behalf. If your plans change, you may transfer your seat to another eligible woman one time, at no penalty, by giving us written notice with the substitute guest's details. Separately, if we cannot deliver the retreat as described, your deposit is refunded in full. Balance payments are refundable only as expressly stated in your reservation communications or as required by law.
Eligibility and conduct
The retreat is intended for adults. You agree to participate respectfully and to follow reasonable safety guidance from EFR and on-site providers. We reserve the right to decline or remove a participant whose conduct is unsafe, unlawful, or materially disruptive, without refund where permitted by law.
Health, assumption of risk, and waiver
Wellness, movement, recovery, and travel activities carry inherent risks. You are responsible for confirming with your physician that you are fit to participate. Participation requires a separate signed health and liability waiver. You assume the risks inherent in the activities to the fullest extent permitted by law.
Travel, documents, and insurance
You are responsible for your own travel to and from the destination region, valid travel documents, and any visas. We strongly recommend travel insurance. EFR is not responsible for losses arising from travel disruptions outside our control.
Alcohol
Alcohol is not provided at the retreat. Any alcohol a guest chooses to obtain on her own time is her sole responsibility.
Limitation of liability
To the fullest extent permitted by law, EFR and its owners, employees, and contractors will not be liable for indirect, incidental, special, or consequential damages, and our total liability relating to the retreat will not exceed the amount you paid to us. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold harmless EFR and its owners, employees, and contractors from claims arising out of your conduct during the retreat or your breach of these Terms, to the extent permitted by law.
Intellectual property
The content on this site, including text, design, and marks, is owned by EFR or its licensors and may not be copied or used without permission.
Governing law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in Illinois, and you consent to their jurisdiction.
Changes
We may update these Terms from time to time. The "Last updated" date reflects the current version. Your continued use of the site after changes are posted constitutes acceptance.
